If the entrepreneur’s activity is subject to a relevant licensing scheme, details of the supervisory authority will be provided.
If the entrepreneur practices a regulated profession:
the professional association or organization to which they are affiliated;
the professional title and the EU or EEA country where it was granted;
a reference to the applicable professional rules and instructions on where and how these rules can be consulted.
These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated prior to concluding the contract that the General Terms and Conditions can be consulted at the entrepreneur’s premises and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these General Terms and Conditions may be made available electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the General Terms and Conditions can be consulted electronically and that they will be sent free of charge upon request.
If specific product or service conditions apply in addition to these General Terms and Conditions, the above provisions apply accordingly, and the consumer may always rely on the provision that is most favorable to them.
If one or more provisions of these General Terms and Conditions are wholly or partially invalid at any time, the agreement and the remaining provisions shall remain in force. The invalid provision shall be replaced by mutual agreement with a provision that most closely reflects the intent of the original provision.
Situations not regulated in these General Terms and Conditions shall be assessed in the spirit of these General Terms and Conditions.
Any ambiguities regarding the interpretation or content of one or more provisions shall be interpreted in the spirit of these General Terms and Conditions.
If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur reserves the right to modify and adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. Images used are a true representation of the products and/or services offered. Obvious mistakes or errors do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot give rise to compensation or dissolution of the contract.
The entrepreneur cannot guarantee that displayed colors correspond exactly to the actual colors of the products.
Each offer clearly states the rights and obligations associated with acceptance, including in particular:
the price including VAT;
any shipping costs;
how the contract will be concluded and what actions are required;
whether the right of withdrawal applies;
the method of payment, delivery, and performance;
the acceptance period or the period during which the price is guaranteed;
the costs of distance communication if different from the standard rate;
whether the contract is archived and how it can be accessed;
how the consumer can review and correct entered data before concluding the contract;
other languages in which the contract may be concluded;
applicable codes of conduct and how they can be consulted;
the minimum duration of the contract in the case of long-term transactions.
Optional: available sizes, colors, and material types.
Subject to Article 4, the contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.
If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt electronically. Until this confirmation is received, the consumer may dissolve the contract.
The entrepreneur will take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe web environment. Appropriate security measures will be taken for electronic payments.
The entrepreneur may, within legal limits, assess whether the consumer can meet payment obligations. If there are justified reasons not to conclude the contract, the entrepreneur may refuse an order or impose special conditions.
The entrepreneur will provide the consumer, in writing or on a durable data carrier, with:
the visiting address for complaints;
information on the right of withdrawal or its exclusion;
information on warranties and after-sales service;
the information referred to in Article 4, unless already provided;
termination conditions if the contract exceeds one year or is indefinite.
For long-term transactions, this applies only to the first delivery.
All contracts are concluded subject to sufficient product availability.
The consumer may withdraw from the contract within 14 days without giving reasons. The period starts the day after receipt of the product.
During this period, the consumer shall handle the product and packaging with care and only unpack or use it as necessary to assess the product.
To exercise the right of withdrawal, the consumer must notify the entrepreneur within 14 days using the model withdrawal form and return the product within a further 14 days. Proof of timely return must be provided.
